Govt plans bills for removal of PM, Union Ministers, UT and State CMs facing serious criminal charges


 

New Delhi, Aug 19: The Centre is set to table three bills in Parliament on Wednesday that will pave the way for the removal of the Prime Minister, Union ministers, state chief ministers, or Union Territory ministers if they are arrested or detained on grave criminal charges.


The legislations in question are the Government of Union Territories (Amendment) Bill, 2025, the Constitution (One Hundred and Thirtieth Amendment) Bill, 2025, and the Jammu and Kashmir Reorganisation (Amendment) Bill, 2025.


Union Home Minister Amit Shah will move a proposal in the Lok Sabha to refer these bills to a joint parliamentary committee for further examination.


At present, the Government of Union Territories Act, 1963 has no provisions for removing a chief minister or minister under custody for serious charges; hence, the amendment seeks to incorporate such a framework through changes to Section 45.


Similarly, the Constitution (130th Amendment) Bill proposes changes to Articles 75, 164, and 239AA to enable removal of the Prime Minister, ministers in the Union Council, as well as chief ministers or ministers of states and Delhi, if they face severe criminal charges leading to custody.


The Jammu and Kashmir Reorganisation (Amendment) Bill, 2025 aims to modify Section 54 of the 2019 Act, which currently lacks any provision for removing the UT’s chief minister or ministers in such circumstances.


These legislative moves are intended to close legal gaps and establish a uniform mechanism for disqualifying top political executives facing grave criminal allegations.
